Schedules of condition
A Schedule of Condition records the true condition of a property. It is often commissioned before the beginning of a commercial lease. The Schedule consists of a written report and a CD with comprehensive photographs. It highlights the construction of the building fabric, any defects and what are called ‘wants of repair’. This ensures an incoming tenant is fully aware of repairing liabilities. The Schedule can be agreed between the landlord’s surveyor and the tenant’s surveyor. The Solicitors can append the Schedule to the lease, confirming that the tenant is not required to return the premises in a better state of repair than is recorded in the Schedule; neither should the landlord be required to accept the ‘demised premises’ in a worse state of repair than is recorded in the Schedule.
