Before embarking on your project, it is important to consider whether you need to take access over neighbouring land and whether you have a right to do so without a private agreement. Taking access without permission may invariably constitute a trespass as typically there is no automatic right to gain access for your scaffold or for the crane to oversail a neighbours land, except in pursuance of the rights under the Party Wall etc. Act 1996.
